By creating an account and using T-REX, you agree to these Terms & Conditions. If you do not agree, do not create an account or use the service. Your continued use of T-REX constitutes ongoing acceptance of these terms.

1. Your Privacy

Your privacy is important to us. Please read the T-REX Privacy Statement (the "Privacy Statement"), as it describes the types of data we collect from you and your devices ("Data"), how we use your Data, and the legal bases we have to process your Data. The Privacy Statement also describes how T-REX uses your content, which is your communications with the T-REX AI Agent; information you submit to T-REX; and the files, photos, documents, audio, images, and data plates that you upload, store, create, generate, or share through the service or inputs that you submit to generate content ("Your Content"). Where processing is based on consent and to the extent permitted by law, by agreeing to these Terms, you consent to T-REX's collection, use, and disclosure of Your Content and Data as described in the Privacy Statement. In some cases, we will provide separate notice and request your consent as referenced in the Privacy Statement.

2. Your Content

Many of our services allow you to create, store, or share Your Content or receive material from others. We don't claim ownership of Your Content. Your Content remains yours and you are responsible for it.

When you share Your Content with other people in your organization, you understand that they may be able to use, save, reproduce, transmit, share, and display Your Content for the purpose you made it available, without compensating you. If you do not want others to have that ability, do not use the service to share Your Content. You represent and warrant that for the duration of these Terms, you have (and will have) all the rights necessary for Your Content that is uploaded, stored, or shared on or through the service, and that the collection, use, and retention of Your Content will not violate any law or rights of others — including any manufacturer's intellectual property, licensing, or confidentiality terms. T-REX cannot be held responsible for Your Content or the material others upload, store, or share using the service.

3. Code of Conduct

You are accountable for your conduct and content when using the service. By agreeing to these Terms, you agree that, when using the service — including the T-REX AI Agent, which may make suggestions or take actions with varying levels of human intervention — you will follow these rules:

  • •Don't do anything illegal, or try to generate or share content that is illegal.
  • •Don't engage in any activity that exploits, harms, or threatens to harm children.
  • •Don't send spam or engage in phishing, or try to generate or distribute malware.
  • •Don't use the service to generate or share inappropriate content or material (involving, for example, nudity, pornography, offensive language, graphic violence, self-harm, or criminal activity).
  • •Don't engage in activity that is fraudulent, false, or misleading (e.g., impersonating someone else, creating fake accounts, or generating content that is intentionally deceptive).
  • •Don't circumvent any restrictions on access to, usage of, or availability of the service (e.g., attempting to "jailbreak" the AI system or impermissible scraping).
  • •Don't engage in activity that is harmful to you, the service, or others (e.g., transmitting viruses, stalking, harassment, hate speech, or advocating violence).
  • •Don't violate or infringe upon the rights of others (e.g., unauthorized sharing of copyrighted service manuals or other copyrighted material, or sharing customer or equipment data in violation of privacy or contractual obligations).
  • •Don't engage in activity that violates the privacy of others, including the privacy of your customers.
  • •Don't help others break these rules.

4. Using the Service & Support

a. T-REX Account

You'll need a T-REX account to access the service. Your account lets you sign in to the T-REX web and mobile apps.

  • •Creating an Account. You can create a T-REX account by signing up. You agree not to use any false, inaccurate, or misleading information when signing up. If your account is provided by your organization (such as an employer or dealership), the organization may have additional rights over your account, including the ability to access, manage, or delete it. If you create an account on behalf of an entity, you represent that you have the legal authority to bind that entity to these Terms. You cannot transfer your account credentials to another user. To protect your account, keep your credentials confidential. You are responsible for all activity that occurs under your account.
  • •Account Use. You must use your account to keep it active. If you don't sign in for an extended period, we may treat your account as inactive and close it. If we reasonably suspect your account is at risk of being used by a third party fraudulently, T-REX may suspend your account until you can reclaim ownership.
  • •Age. By creating an account or using the service, you represent that you have reached the age of majority where you live, or that your parent or legal guardian agrees to these Terms on your behalf. T-REX is a professional tool and is not directed to children.

b. Moderation and Enforcement

Our Code of Conduct identifies what is prohibited when using the service. You can report concerning content or conduct through the Contact page in the app. We may use automated systems and humans to review content to identify suspected abuse, fraud, or harmful conduct. We may block, remove, or decline to display content that appears to violate our Code of Conduct or where required by law. If you violate these Terms, we may take action against your account, including limiting access to features, suspending the service, or closing your account.

c. Work or School Accounts

If you sign in with an account provided by your organization, you agree that the organization may control and administer your account and access and process your Data, including Your Content. Your use may be subject to agreements between your organization and T-REX, and those terms may apply in addition to or in place of these Terms.

d. Equipment and Data Plans

To use the service, you'll need an internet connection and/or data plan, and may need a device with a camera or microphone (for data plate capture and voice input). You are responsible for providing all connections, plans, and equipment and for paying any associated fees.

e. Service Notifications

We may send you service notifications via email, SMS, or in-product messages. Data or messaging rates may apply.

f. Support

Support is available through the Contact page in the app. Support may not be available for preview or beta features.

g. Ending your Service

If your service is canceled, your right to access the service stops immediately. We'll delete Data or Your Content associated with your account, or disassociate it from you, unless we are required by law to keep it. You should maintain your own backups of any work orders or documentation you need to retain.

5. Using Third-Party Apps and Services

T-REX may integrate with or reference third-party services (such as payment processing through Stripe and AI model providers). Your use of those third-party services is subject to their respective terms and privacy policies. T-REX is not responsible for the practices of third-party services.

6. Service Availability

The service may be unavailable from time to time, may be offered for a limited time, or may vary depending on your region or device.

We strive to keep the service up and running; however, all online services suffer occasional disruptions and outages, and T-REX is not liable for any disruption or loss you may suffer as a result. In the event of an outage, you may not be able to retrieve Your Content or Data. We recommend that you regularly back up Your Content and Data.

7. Updates to the Service and Changes to These Terms

We may change these Terms at any time, and we'll tell you when we do. Using the service after the changes become effective means you agree to the new terms. If you don't agree, you must stop using the service.

We may update the service or require software updates to keep using it. We may add, change, or remove features, and may release features in preview or beta form, which may not work as the final version will.

8. Software License

Any software provided by us as part of the service is subject to these Terms. If you comply with these Terms, we grant you the right to install and use one copy of the software per device for use by only one person at a time as part of your use of the service. The software is licensed, not sold, and T-REX reserves all rights not expressly granted. This license does not give you any right to, and you may not:

  • •circumvent or bypass any technological protection measures in or relating to the service;
  • •disassemble, decompile, decrypt, hack, emulate, or reverse engineer any software or aspect of the service, except to the extent applicable law expressly permits;
  • •separate components of the service for use on different devices;
  • •publish, copy, rent, lease, sell, export, import, distribute, or lend the software or the service;
  • •transfer the software, licenses, or any rights to access or use the service;
  • •use the service in any unauthorized way that could interfere with anyone else's use or gain access to any service, data, account, or network.

9. Payment Terms

If you purchase a paid T-REX subscription, these payment terms apply.

a. Charges

You agree to pay the charges for the service. Prices exclude applicable taxes, which you are responsible for. We may suspend or cancel the service if we do not receive timely, full payment.

b. Your Billing Account

You provide a payment method at sign-up through our payment processor, Stripe. You agree to promptly update your account information so we can complete your transactions. T-REX does not store full card numbers.

c. Billing

By providing a payment method, you (i) represent that you are authorized to use it and that the information is true; (ii) authorize T-REX to charge you for the service; and (iii) authorize T-REX to charge you for any paid features you sign up for. We may bill in advance, at purchase, or on a recurring basis for subscriptions.

d. Recurring Payments

Subscriptions are billed on a recurring basis (monthly or annually) until canceled. You must cancel before the next billing date to avoid being charged for the next period. Subscription fees are generally charged in advance.

e. Statements and Errors

You can view your billing through the billing portal in the app. If we make an error on your bill, you must tell us within 90 days.

f. Refund Policy

Unless otherwise provided by law or by a particular offer, all purchases are final and non-refundable. If you believe you were charged in error, contact us within 90 days. We reserve the right to issue refunds or credits at our sole discretion. This policy does not affect any statutory rights that may apply.

g. Canceling the Service

You may cancel at any time through the billing portal. Canceling stops future charges. You may not receive a refund at the time of cancellation, and you may lose access to the service at the end of your current period. If you initiate a chargeback, we may deem you to have canceled as of the date of the original payment and may revoke any access provided for that payment.

h. Trial-Period Offers

If you take part in a trial, you may need to cancel within the communicated timeframe to avoid being charged at the end of the trial.

i. Price Changes

We may change prices and will notify you at least 30 days before a recurring price change. If you don't agree, you must cancel before the change takes effect.

10. Subscription Tiers and AI Credits

T-REX offers three subscription tiers: Basic, Pro, and Expert. Each tier includes a monthly allowance of AI credits. AI credits are consumed when you use the T-REX AI Agent for diagnostics, summaries, or write-ups. Unused credits do not roll over. We may adjust credit allowances and tier features with notice. 11. User-Uploaded Content

Pro and Expert subscribers may upload service manuals, reference documents, and diagnostic images for the T-REX AI Agent to reference during sessions. You are solely responsible for any content you upload. By uploading content, you represent and warrant that: (a) you have the legal right and authorization to upload and share the content; (b) the content does not violate any third-party intellectual property rights, confidentiality agreements, or licensing terms; and (c) the content is accurate and appropriate for its intended use. T-REX uses your uploaded content solely to provide AI-assisted diagnostic and reference services to you and your organization. Your uploaded content and repair data remain your property.

12. Limitation of Liability

If you have any basis for recovering damages (including breach of these Terms), you agree that your exclusive remedy is to recover, from T-REX or its affiliates, direct damages up to an amount equal to your service fee for the month during which the loss or breach occurred (or up to $10.00 if the service is free). You can't recover any other damages or losses, including consequential, lost profits, special, indirect, incidental, or punitive damages. These limitations and exclusions apply even if this remedy doesn't fully compensate you for any losses or fails of its essential purpose, or if we knew or should have known about the possibility of the damages. To the maximum extent permitted by law, these limitations apply to anything or any claims related to these Terms, the service, or the software related to the service.

13. Service-Specific Terms — T-REX AI Agent

The T-REX AI Agent is an AI-powered assistant designed to support qualified heavy equipment technicians with diagnostics, documentation, and repair guidance. The T-REX AI Agent is for your professional, commercial use in the course of field service work.

The T-REX AI Agent provides a range of features, some of which are personalized based on the machine, repair history, and manuals you provide. The T-REX AI Agent may retrieve information from service manuals, your repair history, and — for Expert-tier users — the internet, and will cite its sources. The T-REX AI Agent provides information for your planning and diagnostic purposes only, and you must exercise your own independent professional judgment when reviewing and relying on this information. T-REX does not guarantee the reliability, availability, or timeliness of responses provided by the T-REX AI Agent. T-REX is not responsible if a feature delays or prevents you from receiving, reviewing, or sending information.

As part of delivering the service, the T-REX AI Agent may reference or integrate with third-party services. Your use of those third-party services is subject to section 5. Publishers of third-party services may change or discontinue functionality. T-REX is not responsible or liable for manufacturer-provided software or firmware.

14. Diagnostics and Mechanical Support AI

The T-REX AI Agent, which may include diagnostic suggestions, fault-code interpretations, repair recommendations, action plans, and reminders, is not a diagnostic tool, medical device, or manufacturer-authorized repair system. It is intended for diagnostic and mechanical support purposes to assist qualified technicians. It is not designed or intended as a substitute for manufacturer-authorized diagnostic procedures, OEM service manuals, professional mechanical judgment, or certified repair procedures.

AI-generated diagnostics and repair recommendations may not always be accurate, complete, or applicable to your specific machine or situation. You must verify all AI-generated suggestions against manufacturer specifications, OEM service documentation, industry standards, and your own professional judgment before acting on them.

You assume full responsibility for your use of the T-REX AI Agent and for all repair decisions, diagnostic conclusions, and documentation made with its assistance. T-REX is not responsible for any decision you make based on information you receive from the T-REX AI Agent.

You should always consult the applicable OEM service manual, manufacturer technical support, or a qualified specialist with any questions regarding a specific machine, system, or repair procedure before acting. Never disregard manufacturer-authorized repair procedures or safety protocols because of information you accessed on or through the service.

Heavy equipment repair involves significant safety risks. Always follow applicable safety procedures, lock-out/tag-out protocols, and manufacturer safety guidelines. Do not rely solely on AI-generated suggestions for safety-critical decisions.

As with any technology, the T-REX AI Agent may not work as intended for a variety of reasons, including loss of power, connectivity, or data availability. T-REX does not warrant that the AI Agent will identify the correct root cause or resolve the reported issue.

15. AI Services

AI services are not designed, intended, or to be used as substitutes for professional mechanical, engineering, or legal advice. You may not use the AI services to discover any underlying components of the models, algorithms, and systems. Unless explicitly permitted, you may not use web scraping, web harvesting, or web data extraction methods to extract data from the AI services. You may not use the AI services, or data from the AI services, to create, train, or improve (directly or indirectly) any competing AI technology.

As part of providing the AI services, T-REX will process and store your inputs and outputs for purposes of monitoring for and preventing abusive or harmful uses, and to provide and improve the service as described in the Privacy Statement.

T-REX doesn't claim ownership of any content you provide, post, input, or submit to, or receive from, the AI services. You must make your own determination regarding the intellectual property rights you have in output content, taking into account your usage and the laws of the relevant jurisdiction. You warrant that you own or control all rights necessary to provide, post, upload, input, or submit your content. You may not use the AI services to generate content with the purpose of misleading others about whether content was generated using AI.

You are solely responsible for responding to any third-party claims regarding your use of the AI services, including copyright or other claims relating to content output during your use. In addition to the Code of Conduct, you will not use the AI services to make decisions or take actions without appropriate human oversight that may have a consequential impact on any person's legal position, financial position, employment, or safety, or that may result in physical or psychological harm; to deceive or intentionally misinform; to exploit vulnerabilities of any person; or for any discriminatory, harmful, or unlawful profiling.

16. Binding Arbitration and Class Action Waiver (United States)

If you live in (or, if a business, your principal place of business is in) the United States, we hope we never have a dispute, but if we do, you and we agree to try for 60 days, upon receipt of a Notice of Dispute, to resolve it informally. If we can't, you and we agree to binding individual arbitration, and not to sue in court in front of a judge or jury. Class action lawsuits, class-wide arbitrations, and any other representative proceedings aren't allowed.

  • •Disputes Covered. "Dispute" includes any claim between you and us concerning the service, its price, your account, billing, or these Terms, under any legal theory, except disputes relating to intellectual property rights.
  • •Notice of Dispute. Before arbitration, you must send a Notice of Dispute through the Contact page in the app, with all relevant information. This is a prerequisite to initiating arbitration.
  • •Small Claims Court. Either party may sue in small claims court seeking individual relief, so long as the action meets the court's requirements.
  • •Severability. If any part of this section is found unenforceable, the remainder will remain in effect.

17. Miscellaneous

Sections 1, 9 (for amounts incurred), 12, 16, and those that by their terms apply after the Terms end will survive any termination. We may assign these Terms at any time without notice. You may not assign your rights or obligations under these Terms. This is the entire agreement between you and T-REX for your use of the service, superseding any prior agreements. If a court holds that we can't enforce a part of these Terms as written, we may replace those terms with similar enforceable terms, but the rest won't change.

18. Export Laws

You must comply with all domestic and international export laws and regulations that apply to the software and/or service, including restrictions on destinations, end users, and end use.

19. Reservation of Rights and Feedback

Except as expressly provided under these Terms, T-REX does not grant you any license or other rights under any patents, copyrights, trade secrets, trademarks, or other intellectual property owned or controlled by T-REX. If you give T-REX any idea, proposal, suggestion, or feedback ("Feedback"), you grant T-REX, without charge, the right to use, share, and commercialize your Feedback in any way and for any purpose.

Notices

Intellectual property infringement. T-REX respects the intellectual property rights of third parties, including OEM service manuals and copyrighted technical documentation. If you wish to send a notice of intellectual property infringement, contact us through the Contact page in the app. In appropriate circumstances, T-REX may disable or terminate accounts of users who may be repeat infringers.

Copyright and trademark notices. The service is copyright © T-REX. All rights reserved. "T-REX" and the T-REX logo are trademarks of T-REX. The names of actual companies, manufacturers, and products may be the trademarks of their respective owners. Any rights not expressly granted in these Terms are reserved.

No professional advice. T-REX does not provide engineering, legal, or medical advice. Always consult the applicable OEM documentation, manufacturer technical support, or a qualified professional with any questions regarding a specific machine, repair procedure, or safety matter. Never disregard professional guidance or safety protocols because of information you accessed on or through the service.

Disclaimer of Warranty

The service is licensed "as is," "with all faults," and "as available." You bear the entire risk as to its quality and performance. T-REX gives no express warranties, guarantees, or conditions in relation to the service. To the extent permitted by law, T-REX excludes any implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation on Remedies and Damages

To the extent not prohibited by law, if you have any basis for recovering damages, you can recover from T-REX only direct damages up to the amount you paid for the service or $1.00, whichever is greater. You will not seek any other damages, including lost profits and consequential, special, indirect, or incidental damages. This limitation applies to anything related to the service and to all claims under any theory, and applies even if this remedy doesn't fully compensate you or T-REX knew or should have known about the possibility of the damages.
